Update to Instructional Unit requirements for Rule 10

The “Instructional Unit Subject Area Totals” report for the 2023-2024 school year in ADVISER Validation will be updated on 3/15/2024 with additional course offerings derived from high school course sections that have teachers but no students assigned to them. The notification explaining this change (copied below) will also be emailed out to superintendents on 3/14/2024:

 

Dear Nebraska Superintendents,

The Accreditation section of the NDE is notifying schools of a revised interpretation of language within Rule 10 that will allow for flexibility in meeting the instructional unit requirements. The revised interpretation ensures diverse opportunities for students while maintaining the standards of the requirement.

Rule 10 definition 002.12 Instructional Unit means 15 clock hours (900 minutes) of classroom instruction in a course offered in the secondary school. An “offered” course must meet the following criteria:

  • The course offerings will meet all the necessary requirements under current Rule 10.
  • A certificated teacher is available to be assigned to each course offered as part of the teacher’s daily schedule.
  • Course offerings are available for students to access.
  • The course has been identified as part of the current school year master schedule.

 

Districts will demonstrate that class offerings were available to students for the current school year through the following:

  • Submission of a completed and signed the Rule 10 Assurance Statement.
  • Uploaded course information through ADVISER as a “Course Offering” during the current school year.
  • Proof of “Course Offerings” if requested: Registration materials for grades 9-12 of current school year.

New Error 801 – No Discipline Records Reported
No discipline records have been reported at the listed school(s) as of May 1st. Please review data to make sure that there are no discipline incidents at the school, otherwise if the data is correct then this warning may be archived.

Please note, this Warning will not activate in ADVISER Validation until May 1st of the school year.

2023-2024 Title I Nonpublic Consultation Form Open

The 2023-2024 Title I Nonpublic Consultation Form is now open in the NDE portal. This collection is due on April 30, 2024 and has an audit window from May 1-15, 2024.

This collection is used to meet the ESEA Title I requirements for consultation between public schools who have resident low-income school-aged students attending a nonpublic school. This does not apply to rule 12 or 13 exempt schools. There is one form for each nonpublic schools having eligible students in attendance.

The Title I Nonpublic Consultation Form is found in the Consolidated Data Collection (CDC) in the Data Collections Tab. If it’s not available on your account, you can obtain the activation code for the CDC collection from your school’s Portal District Administrator.

Counselor and Library / Media Specialist Not Endorsed 23-24 Collection Now Open

The 2023-2024 Counselor and Library/ Media Specialist Not Endorsed collection is NOW OPEN in the NDE Portal. The DUE date for this data is April 1st, 2024. This data collection is used to monitor a staff member’s progress on obtaining the proper endorsement per flexibility stated in Rule 10: Regulations and Procedures for the Accreditation of Schools.  The option for allowing individuals not properly endorsed to serve in either capacity is described in Rule 10, Section 007.04B Media/Technology Staff and Section 007.05D Guidance Staff.

Conditional and Alternative Permit Requests – Spring 2024

The purpose of this bulletin item is to provide information on how to request a conditional or alternative permit for teachers who have been hired to start in SPRING 2024 and may not have all their necessary documentation prior to the first day of school with students.

A conditional permit allows someone to sign a contract and work as a certified staff member with a location (district) limitation and deficiencies that have not been met to issued a regular teaching certificate such as a content test. A conditional permit can also be requested for someone who has applied for a local substitute permit and has not completed the human relations training course.

An Alternative Permit is designed for an applicant to complete a program before applying for a regular certificate while being employed as a contracted teacher.
Conditional and Alternative Permits can only be requested for employment in a Nebraska school district. If an applicant has not been a continuous resident of Nebraska for the last five years, fingerprint cards will need to be sent to the certification office before any permits can be issued. Once all deficiencies listed have been satisfied on a conditional permit, a regular certificate/permit will be issued without the need to apply and pay a fee unless the conditional permit has been invalidated by the expiration date.

CORRECTION – Local Substitute Teaching Permit – Request for Additional Days Form

The Nebraska Department of Education (NDE) is aware of the continued shortage of substitute teachers in school systems this school year.

The Commissioner may authorize additional days for local substitute teaching permit holders upon request by a Nebraska school system that demonstrates a need for additional days, beyond the 90 full-time days per school year currently allowed.  In order to authorize the additional days, the Department must receive a request from a Nebraska school system that demonstrates need.

To facilitate school system requests, the Department has created an online form. You or your school system staff can access that form here: Local Substitute Teaching Permit – Request for Additional Days Form.

Once a request has been submitted, it will be reviewed, and the school system will be notified of the authorization.
